A court hearing on the fate of two dogs that were ordered to be euthanized by the Hollister Police Department after the killing of two cats in October was continued for a second time because the appellants’ lawyer is “extremely ill,” according to court records.

The continuance, signed by both parties and filed by appellant’s lawyer, Greg LaForge, was submitted to the court on Jan. 20, a day before the scheduled hearing.

The San Benito County Superior Court hearing that was scheduled for Jan. 21 was moved to Feb. 18 at 1:30 p.m.

The dogs—Bubba, a five-year-old terrier mix, and Stewie, a one-year-old German shorthaired pointer—are owned by Timothy and Yuko Pierson, who are appealing the Hollister Police euthanasia order in Superior Court.

The first hearing on Jan. 7 was continued because LaForge said he had not thoroughly reviewed the Hollister Police Department’s brief, which he said he received late Jan. 2 and was 90-plus pages.

Hollister Police Department classified the two dogs as “dangerous animals” after accusing them of intentionally killing two cats following two incidents in which the dogs escaped from the back yard of the owners, according to the complaint filed by the police.

The police issued an order on Nov. 20 to “humanely destroy Stewie and Bubba.”
